WHEREAS, the current water supply conditions warrant activation of the Water <br />Conservation Level 1 Water Shortage stage of the City's Water Conservation <br />Ordinance, in accordance with Section 39 -107 of the City Municipal Code, to help <br />mitigate drought impacts by implementing augmented water use restrictions in addition <br />to the permanent measures already in place. <br />NOW, THEREFORE, the City Council of the City of Santa Ana hereby finds, <br />determines and declares as follows that: <br />Section 1. The foregoing recitals are true and correct and are hereby <br />incorporated by reference. <br />Section 2. The City's water supply is in a Water Conservation Level 1 Water <br />Shortage. <br />Section 3. In addition to the permanent water conservation requirements in <br />place, all mandatory Water Conservation Level 1 measures will be implemented as <br />described in Section 39 -107. Specifically, the following water conservation requirements <br />apply during a declared level 1 water shortage: <br />A. Restrictions on watering lawn, landscape or other turf areas shall be modified <br />to prohibit watering more often than every other day and such areas shall only <br />be watered between the hours of 6:00 p.m. and 6:00 a.m. This provision shall <br />not apply to commercial nurseries and golf courses. <br />B. The watering of lawn, landscape or other turf areas of commercial nurseries <br />or golf courses shall be allowed between the hours of 6:00 p.m. and 6:00 a.m. <br />There shall be no restriction on watering utilizing reclaimed water. <br />C. No customer shall make, cause, use or permit the use of water for any <br />purpose in excess of ninety seven percent (97 %) of the amount used in the <br />customer's premises during the corresponding billing period of the base year. <br />For existing customers, the "base year" shall be measured by taking into <br />account the prior six (6) billing periods from the effective date of this <br />resolution. For example, for purposes of comparison, a billing period that <br />covers the months of June -July will be compared to the closest corresponding <br />billing cycle of the base year. For new customers, the "base year" shall be <br />measured by taking into account the first six (6) billing periods. There shall be <br />no restriction on the use of reclaimed.,water under this provision. <br />P <br />D. All leaks, breaks, or other malfunctions in the- water user's plumbing or <br />distribution system must be repaired within seventy -two .(72) hours of <br />notification by.'the city, ..unless other arrangements are made with the city. <br />Resolytion No. 2014 -056 <br />Page 2 of 4 <br />
