WHEREAS, pursuant to CEQA Guidelines section 15086, the City consulted with <br />and requested comments from all responsible and trustee agencies, other regulatory <br />agencies, and others during the 45 -day comment period, which ran through December <br />17, 2012; and <br />WHEREAS, during the 45 -day public review period, the City held a regularly <br />scheduled public hearing on November 13, 2012, to receive comments regarding the <br />Draft EIR; and <br />WHEREAS, the City received 26 written comment letters during the second <br />public review period for the Draft EIR; and <br />WHEREAS, the City has prepared a Final EIR, consisting of comments received <br />during both 45 -day public review and comment periods on the Draft EIR, written <br />responses to those comments, and revisions and errata to the Draft EIR. For the <br />purposes of this Resolution, the "EIR" shall refer to the Draft EIR, including all of the <br />technical studies and appendices to the Draft EIR, as revised by the Final EIR's errata <br />section, together with the other sections of the Final EIR, including all of the technical <br />studies, attachments and appendices to the Final EIR; and <br />WHEREAS, the Planning Commission of the City of Santa Ana held a duly <br />noticed public hearing on February 10, 2014, and voted to recommend that the City <br />Council: (1) Adopt a resolution certifying Final Environmental Impact Report No. 2011 -01 <br />and approve the mitigation monitoring program for the proposed Project; (2) Adopt a <br />resolution approving Variance No. 2012 -04(a) for the Project as conditioned; (3) Adopt a <br />resolution approving Variance No. 2012 -04(b) to allow a reduction in the minimum lot <br />frontage as conditioned; and (4) Adopt a resolution approving Vesting Tentative Tract <br />Map No. 2012 -02 (County Map No. 17231) as conditioned; and <br />WHEREAS, on or about March 4, 2014, the City Council held a duly noticed <br />public hearing and at that time considered all testimony, written and oral, and approved <br />Resolution No. 2014 -009, certifying the EIR and approving the Project; and <br />WHEREAS, the findings of fact attached to this resolution reflect the addition of <br />an alternative analysis, the Historic Preservation Analysis, to reflect the City Council's <br />adoption of this alternative as the environmentally superior preferred alternative; and <br />WHEREAS, the City Council of the City of Santa Ana held another duly noticed <br />public hearing on September 2, 2014, to consider this updated Resolution certifying the <br />FEIR (which attaches and incorporates by reference the findings), and the re- adoption <br />of the underlying resolution for the entitlements for the proposed Project, i.e., the <br />approval of two variances and approving a vesting tentative tract map; and <br />WHEREAS, at its duly noticed public hearing on September 2, 2014, the City <br />Council considered all testimony, written and oral, submitted on the proposed Project <br />and this Resolution; and <br />Resolution No. 2014 -060 <br />Page 3 of 12 <br />
