BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. Recitals. The recitals above are true and correct and are <br />incorporated into this Resolution by reference as findings of fact. <br />Section 2. Review Period. The City provided two 45 -day public review periods <br />for the Draft EIR, which exceeds the minimum requirements under CEQA Guidelines <br />sections 15073 and 15105; and <br />Section 3. Certification. The City hereby certifies that (1) the EIR has been <br />prepared, processed, and noticed in accordance with CEQA and the State CEQA <br />Guidelines; (2) the EIR was presented to the City Council and the City Council has <br />reviewed and considered the information contained in the EIR prior to considering <br />adoption of the Project, and (3) the EIR reflects the independent judgment and analysis <br />of the City Council and is deemed adequate for the purposes of making decisions on <br />the merits of the Project. <br />Section 4. CEQA Findings. The City hereby adopts the CEQA Findings, <br />which were prepared in accordance with Public Resources Code section 15091 and <br />which are attached hereto as Exhibit A and incorporated herein by this reference as if <br />fully set forth herein. <br />Section 5. Mitigation Monitoring Program. Pursuant to Public Resources <br />Code section 21081.6, the City Council hereby adopts the Mitigation Monitoring <br />Program attached hereto as Exhibit B and incorporated herein by this reference. The <br />City finds that Mitigation Monitoring Program is designed to ensure that, during the <br />implementation of the Project, the City and any other responsible parties implement the <br />components of the Project and comply with the mitigation measures identified in the <br />Mitigation Monitoring Program. <br />Section 6. Findings for Variance No. 2012- 04(a). Development of the <br />proposed Project requires approval of Variance No. 2012 -04(a) to allow the Sexlinger <br />Farmhouse to remain at its current location in the Single Family Residence (R -1) zoning <br />district. Santa Ana Municipal Code (SAMC) section 41 -234 requires a front yard <br />setback of twenty (20) feet. SAMC section 41- 239(g) requires the garage to be a <br />minimum of five feet from the residence. SAMC section 41- 1320(b) requires the <br />residence to provide a two -car garage. Reductions in each of these standards is <br />required to keep the historic Farmhouse in its current location. The City Council <br />determines that the following findings, which must be established pursuant to Santa Ana <br />Municipal Code Section 41 -638 in order to grant a variance, have been established: <br />A. That because of special circumstances applicable to the subject property, <br />including size, shape, topography, location or surroundings, that the strict <br />application of the zoning ordinance is found to deprive the subject property <br />of privileges not otherwise at variance with the intent and purpose of the <br />provisions of this Chapter. <br />Resolution No. 2014 -060 <br />Page 5 of 12 <br />
