REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />OCTOBER 21, 2014 <br />TITLE: <br />CONDITIONAL USE PERMIT NO. 2014 -32 TO <br />ALLOW A TYPE 41 ALCOHOLIC BEVERAGE <br />CONTROL LICENSE FOR DOG HAUS <br />RESTAURANT LOCATED AT 2800 NORTH MAIN <br />STREET, UNIT 197 - SHOGHIG YEPREMIAN, <br />APPLICANT (STRATEGIC PLAN NO. 3, 2) <br />CITY MANAG <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 15' Reading <br />❑ Ordinance on 2ntl Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Conditional Use Permit No. 2014 -32. <br />PLANNING COMMISSION ACTION <br />On September 22, 2014, the Planning Commission adopted a resolution approving Conditional <br />Use Permit No. 2014 -32 by a vote of 6:0 (Alderete absent) which approved a Type 41 Alcoholic <br />Beverage Control license in order to sell beer and wine for on- premise consumption at Dog Haus <br />restaurant located at 2800 North Main Street, Unit 197 in the General Commercial (C2) zoning <br />district. The Planning Commission made no changes to the recommended conditions of <br />approval outlined in the attached staff report (Exhibit A). <br />DISCUSSION <br />Dog Haus restaurant is currently constructing tenant improvements to open a new eating <br />establishment at 2800 North Main Street, Unit 197. Dog Haus is requesting approval of a Type 41 <br />ABC license to allow the on- premise sale of beer and wine as part of the eating establishment's <br />operations. The restaurant will be maintained as a full- service, sit -down eating establishment <br />with an outdoor patio area. The dining area will contain approximately 40 seats and will have all <br />necessary equipment to be considered for a Type 41 ABC license. The proposed patio area will <br />have seating for about 30 patrons and be enclosed with a 36 -inch high fence that is in <br />compliance with all applicable City and State Department of Alcoholic Beverage Control <br />standards. The on- premise sale of alcoholic beverages to customers is intended to provide a <br />service ancillary to the primary restaurant use. The hours of operation for the restaurant will be <br />from 10:00 a.m. to 10:00 p.m. Monday through Sunday.
