The variance allowed the construction of a <br />6,900 square foot building and granted relief from the City's front and side yard setback standards. <br />Due to a significant shift in the local, state and national economies that commenced several years <br />ago, the property owner has been impacted by the economic downturn and has been unable to <br />start construction of the project. As a result, the entitlement for the site is ready to expire. <br />Entitlements for development projects expire two years from the date of approval unless <br />construction has commenced. Since construction has yet to begin, the applicant would like to <br />maintain the entitlement for the variance and is requesting an extension. Section 41 -647 of the <br />Santa Ana Municipal Code (SAMC) requires the City Council to approve any request for an <br />extension of an entitlement. Although the project has yet to be submitted into building plan check, <br />the applicant is hopeful that the recent shift in the economy will allow him the ability to construct the <br />project and find a tenant(s) for the building. As a result, the Planning Division recommends that the <br />entitlement for the commercial building be extended by a period of one year from date of original <br />approval to October 14, 2015. If construction has not commenced by this date, the applicant has <br />the ability to request an additional extension. <br />ENVIRONMENTAL IMPACT <br />In accordance with the California Environmental Quality Act, this project is exempt from CEQA per <br />Section 15061 (b)(3), This determination has been made as it has been determined that the <br />proposed action will not cause a significant effect on the environment. <br />55AA -1 <br />
