employer cost of the 3% at 50 enhanced retirement formula. This payment shall be <br />implemented as cost - sharing pursuant to Government Code Section 20516(f). <br />Pre - Taxable Benefit. To the extent permitted by Ca1PERS and Internal Revenue Service <br />regulations this nine percent (9 %) employee contribution shall be implemented through <br />payroll deduction on a pre -tax basis. <br />2.7% @ 57 Retirement Benefit for New Safety Members. The City agrees to provide Safety <br />employees covered by this Agreement who are defined as New Members under PEPRA with <br />the 2.7% @ 57 Service Retirement benefit. <br />The PEPRA went into effect on January 1, 2013. The parties agree that if there is any other <br />clean up or other retirement legislation which goes into effect during this MOU and if there <br />are provisions of that legislation which, by law, automatically goes into effect, either party <br />may request to negotiate over the legislation, including over the impact. <br />Final compensation for New Safety Members will be based on the highest annual average <br />compensation earnable during the 36 consecutive months immediately preceding the <br />effective date of his or her retirement, or some other 36 consecutive month period designated <br />by the member. <br />Effective July 1, 2013, employees covered under the 2.7% @ 57 retirement formula for <br />Safety shall pay one half of the normal cost rate, as established by CalPERS. <br />14.7 Military Service Credit as Public Service. Effective March 8, 2001, "safety" employees and <br />effective April 5, 2002, "miscellaneous" employees, respectively, may elect to purchase up to <br />four (4) years of service credit for any continuous active military or merchant marine service <br />prior to employment. The employee must contribute an amount equal to the contribution for <br />current and prior service that the employee and the employer would have made with respect <br />to that period of service. <br />14.8 Credit for Unused Sick Leave. Effective January 1, 2002, a non -sworn employee covered by <br />this Agreement can have unused accumulated sick leave at the time of retirement converted <br />to additional service credit, at the rate of 0.004 years of service credit for each day of unused <br />sick leave (i.e., 200 days of sick leave equals .80 additional years of service credit)., pursuant <br />to regulations prescribed by PERS. The maximum total unused sick leave that can be <br />converted shall be two hundred (200), eight (8) hours working days (1600 hours). Any <br />accumulated sick leave in excess of 1600 hours shall be forfeited. The City must report only <br />those hours of unused sick leave that were accrued by the employee during the normal course <br />of employment. This section applies to members whose effective date of retirement is within <br />four (4) months of separation from employment. Effective July 1, 2007, the provisions of <br />this section will also apply to sworn employees covered by this Agreement. <br />40 <br />
