REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />NOVEMBER 18, 2014 <br />TITLE: <br />AGREEMENT AMENDMENT WITH <br />SERVICE FIRST FOR FOUNTAIN <br />MAINTENANCE SERVICES <br />(STRATEGIC PLAN NO. 6, 1B) <br />CITY MANAGE <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on I" Reading <br />❑ Ordinance on 2n' Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute an amendment to the agreement <br />with Service First for fountain maintenance services, increasing the compensation by $19,490 to <br />an amount not -to- exceed $63,480, which includes a 15% contingency, annually, for the period <br />through December 31, 2015, subject to non - substantive changes approved by the City Manager <br />and the City Attorney. <br />DISCUSSION <br />The Parks, Recreation and Community Services Agency is responsible for the routine <br />maintenance of the fountains located in the Downtown Civic Center, including the Plaza of the <br />Fountains (three fountains), Plaza of the Sun, Sasscer Park, the 2nd Street Mall fountain, and the <br />Santa Ana Regional Transportation Center ( SARTC) fountain. <br />On December 16, 2013, the City Council approved the first of two, two -year contract extensions <br />to maintain the fountains. The first of the two -year agreement extensions is set to expire <br />December 31, 2015. Staff recommends an increase to the scope of work to provide two <br />additional days of service per week for the fountains in the civic center area and one additional <br />day of service per week for the SARTC fountain. Additionally, staff requests an adjustment to the <br />contingency amount to reflect 15% of the annual contract amount. The cost of the increased <br />scope of work and adjusted contingency will result in increasing the existing contract by $19,490. <br />The fountains are currently maintained one day per week. The increase in activity in the Civic <br />Center requires additional weekly maintenance of the fountains to clean the skimmers, vacuum <br />the bottom of the fountain, review the chlorine balance and equipment to avoid any blockage and <br />breakdown of the pump and filtration system. Filtration blockages and vandalism have caused <br />fountains to overflow, increased stress on the fountain equipment and breakdowns, which then <br />results in emergency repairs. For this reason staff is recommending a contingency of 15% of the <br />contract amount. <br />25M -1 <br />
