REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />NOVEMBER 18, 2014 <br />TITLE: <br />CONDITIONAL USE PERMIT NO. 2014 -29 TO <br />ALLOW A TYPE 41 ALCOHOLIC BEVERAGE <br />CONTROL LICENSE FOR BLAZE PIZZA <br />RESTAURANT LOCATED AT 2800 NORTH <br />MAIN STREET, UNIT 1968 — ALVARO <br />MORALES, APPLICANT (STRATEGIC PLAN <br />NO. 3, 2) <br />CITY MANAG <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1' Reading <br />❑ Ordinance on 2ntl Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Conditional Use Permit No. 2014 -29. <br />PLANNING COMMISSION ACTION <br />On October 27, 2014, the Planning Commission adopted a resolution approving Conditional Use <br />Permit No. 2014 -29 by a vote of 6:0 (Alderete absent) which approved a Type 41 Alcoholic <br />Beverage Control license to allow the on- premise sale and consumption of beer and wine at the <br />Blaze Pizza restaurant located at 2800 North Main Street, Unit 1968 located in the General <br />Commercial (C2) zoning district. The Planning Commission made no changes to the <br />recommended conditions of approval outlined in the attached staff report (Exhibit A). <br />DISCUSSION <br />Blaze Pizza restaurant is requesting approval of a Type 41 ABC license to allow the on- premise <br />sale of beer and wine as part of the eating establishment's operations. The restaurant will be <br />maintained as a full - service, sit -down eating establishment with two patio areas. The dining area <br />will contain approximately 38 seats and will have all necessary equipment to be considered for a <br />Type 41 ABC license. The proposed interior patio area will have seating for 24 patrons and the <br />exterior patio area will have seating for about 30 patrons, both of which will be enclosed with a <br />36 -inch high fence that will be in compliance with all applicable City and State Department of <br />Alcoholic Beverage Control standards. The on- premise sale of alcoholic beverages to customers <br />is intended to provide a service ancillary to the primary restaurant use. The hours of operation <br />for the restaurant will be from 11:00 a.m. to 10:00 p.m. Monday through Sunday.
