Harbor Boulevard Mixed Use Transit Corridor Plan <br />Findings and Facts in Support of Findings and Statement of Overriding Considerations <br />stationary noise, but would increase the residential density in the area, which would <br />have the potential to expose persons to stationary noise above the City's noise <br />ordinance criteria. <br />No site - specific development is proposed at this time. Therefore, the specifications, <br />design features, and /or location of these potential noise sources and the resulting <br />effect of future development on nearby sensitive receptors cannot be quantified at <br />this time. However, Mitigation Measure 9 -2 would require project applicants to submit <br />acoustic reports that demonstrate that operation of proposed land uses would not <br />excessively increase noise levels. With implementation of Mitigation Measure 9 -2, <br />this impact would be less than significant. <br />Mitigation Measures <br />MM 9 -2 Prior to issuance of a building permit, applicants for new <br />commercial, office, or retail developments in the Harbor Corridor <br />Plan shall submit an acoustic report prepared to the satisfaction of <br />the Zoning Administrator and Building Official or their designee to <br />ensure that the operation of stationary noise sources (i.e., HVAC <br />units, truck deliveries) would not cause a noise increase of more <br />than 5 dBA over the ambient noise levels at any adjacent <br />property. These noise studies would need to be submitted after <br />the precise grading and architectural plans are prepared, but prior <br />to issuance of building permits. This requirement can be <br />accomplished with selection of quieter equipment, judicious site <br />layouts and equipment positioning, and /or equipment enclosures, <br />sound screening, or parapet walls. These features shall be shown <br />on all building plans and incorporated into the construction of the <br />project. City inspectors shall verify compliance of the building with <br />the acoustic report's recommendations prior to issuance of a <br />Certificate of Occupancy. <br />(3) Potential Impact: Construction activities would generate high levels of ground -borne <br />vibration. <br />Finding: 1. The City hereby makes Finding 1 and determines that this impact is less <br />than significant with the incorporation of the proposed mitigation measure. <br />Facts in Support of Finding <br />The closest vibration - sensitive structures are existing and future residential uses in <br />the project area. In addition, residential areas immediately adjacent to the <br />boundaries of the project area are also considered vibration sensitive and would <br />have the potential to be affected by construction activities during implementation of <br />the Harbor Corridor Plan. However, implementation of Mitigation Measure 9 -3 would <br />ensure that project applicants minimize construction - related vibration related to their <br />projects. The measure requires applicants to prepare a vibration report to the <br />satisfaction of the City and use equipment that produces low levels of vibration. Upon <br />implementation of Mitigation Measure 9 -3, this impact would be less than significant. <br />35 July 2014 <br />
