CITY OF SANTA ANA <br />CONTRACT <br />(^ PROJECT NO. 11 -6416 <br />SEVENTENTH STREET WATER MAIN IMPROVEMENTS <br />CONSTRUCTION CONTRACT <br />This CONTRACT is made and entered into this _ day of , 20 by and between: <br />The CITY OF SANTA ANA, CALIFORNIA, a charter city and municipal corporation organized and <br />existing under the Constitution and laws of the State of California, hereinafter referred to as <br />"CITY" and <br />referred to as "CONTRACTOR." <br />WITNESSETH: <br />CONTRACTOR shall perform everything required to be performed, shall furnish and provide all <br />the labor, materials, necessary tools, expendable equipment, utility and transportation services, <br />all at its own cost and expense necessary to construct and complete in a good and workman- <br />like manner, to the satisfaction of the City Engineer of the CITY, the following Work of <br />Improvement therefore prepared by the City's Public Works Agency: <br />(the "Work of Improvement ") all in accordance with the Contract Documents and Contractor's <br />Proposal dated /_0- ,2(— aY2161 <br />CITY and the CONTRACTOR, for the consideration hereinafter named, mutually agree as follows: <br />1. The complete Construction Contract consists of the Contract Documents set forth in <br />Exhibit "A" which is attached hereto and incorporated herein by reference. In case of <br />conflict amongst the Contract Documents, the precedence of documents shall be as. <br />established in the Special Provisions. <br />2. CITY agrees to pay and CONTRACTOR agrees to accept in full payment for this Work of <br />lArovement the stinulated sum of; A 2 I /1 A <br />11,p k Z64 d eCY rs as set <br />forth in Exhibit "B" which is at ached hereto, incorporated herein by reference, and <br />identified as BID PROPOSAL. The BID PROPOSAL contains a schedule of unit price(s) or <br />lump sum(s) based on approximate quantities only, and the City does not expressly or <br />by implication agree that the actual amount of work will correspond therewith, but <br />reserves the right to increase or decrease the amount of any class or portion of the work <br />or to omit portions of the work as may be deemed necessary or advisable. <br />Section 4- a Contra t 09 -22 -2014 C -1 a <br />23A -49 <br />
