CITY OF SANTA ANA <br />SPECIFICATIONS <br />specified or approved by the City Engineer in writing. In all cases where proprietary articles are <br />specified, it is the intent of these specifications to permit the use of approved equals, unless <br />specifically prohibited. Requests for "Approved Equal" status for proposed substitutions shall <br />be submitted within ten (10) days after the award of the contract. Such requests shall include <br />substantiating data and the proposed credit to the contract price for the use of such <br />substitution, should it be approved. <br />Approved, Required, Directed — or words of similar import, refer to and indicate that the work <br />or materials shall be "approved," "required," or "directed" by the City of Santa Ana or its duly <br />authorized representative. <br />Bidder — any individual, firm, partnership, corporation, or combination thereof, submitting a <br />proposal for the work contemplated, acting directly or through a duly authorized <br />representative. <br />Board — City Council of the City of Santa Ana <br />City — City of Santa Ana <br />City Council —The body constituting the awarding authority of the City, namely the City Council <br />of the City of Santa Ana. <br />Contractor — The person or persons, co- partnership or corporation, private or municipal, who <br />have entered into contract for this work as parties or party of the second part of his or her legal <br />representatives. <br />Day — Working day or Calendar day as specified in the Construction Contract / Agreement <br />and /or in the Contractor's Bid Proposal. <br />Department of Public Works or Department — City of Santa Ana Public Works Agency. <br />Due Notice — A written notification, given in due time, of a proposed action where such <br />notification is required by the contract to be given a specified interval of time (usually 48 hours <br />or two working days) prior to the commencement of the contemplated action. Notification <br />may be from City to Contractor or from Contractor to City. <br />Engineer — The City Engineer of the City of Santa Ana, acting either directly or through <br />authorized agent. <br />Laboratory —Any laboratory of a public agency or a recognized commercial testing laboratory. <br />Owner — City of Santa Ana <br />S -lb <br />23A -58 <br />
