CITY OF SANTA ANA <br />SPECIFICATIONS <br />Defined Claim, and be filed with the Owner on or before the date of the final payment for <br />the work. <br />If the Defined Claim is less than $50,000, the new Owner shall respond in writing to the <br />Defined Claim within 45 days of its receipt; or the Owner may request in writing within <br />30 days of receipt of the Defined Claim any additional documentation supporting the <br />Defined Claim or relating to defenses or claims the Owner may have against the <br />Contractor, and in such event the Owner's response shall be submitted to the <br />Contractor within the later of 15 days after the receipt of the further documentation, or <br />the time taken by the Contractor in producing the additional information. <br />If the Defined Claim is over $50,000, the Owner shall respond in writing to the Defined <br />Claim within 60 days of its receipt, or the Owner may request in writing within 30 days <br />of receipt of the Defined Claim any additional documentation supporting the Defined <br />Claim or relating to defenses or claims the Owner may have against the Contractor, and <br />in such event the Owner's response shall be submitted to the Contractor within the later <br />of 30 days after the receipt of the further documentation, or the time taken by the <br />Contractor in producing the additional information or requested documentation. <br />Meet and Confer Regarding Defined Claim If the Contractor disputes the Owner's written <br />response, or if the Owner fails to respond within the prescribed time, to the Defined Claim, <br />the Contractor may notify the Owner in writing within 15 days, and demand an informal <br />conference to meet and confer for settlement of the issues in dispute. Upon receipt of the <br />demand, the Owner shall schedule a meet and confer conference within 30 days. If the <br />claim or any portion thereof remains in dispute following the meet and confer conference, <br />the Contractor may file a claim pursuant to Government Code Section 900, et seq. For <br />purposes of this Paragraph B, the running of the period of time within which a claim must <br />be filed shall be tolled from the time the Contractor submits the Defined Claim until the <br />time such Defined Claim is denied, including any period of time utilized by the meet and <br />confer conference. <br />Procedures for Civil Actions Filed to Resolve Defined Claims The following procedures shall <br />apply to any civil action filed pursuant to this Paragraph B: <br />Non - Binding Mediation Within 60 days, but no earlier than 30 days, following the filing <br />of responsive pleadings, the court shall submit the matter to non - binding mediation <br />unless waived by mutual stipulation of both parties. The mediation process shall <br />provide for the selection within 15 days by both parties of a disinterested third person <br />as mediator, and shall be commenced within 30 days of the submittal and shall be <br />concluded within 15 days from the commencement of the mediation unless a time <br />requirement is extended upon a good cause showing to the court. <br />S -3b <br />23A -64 <br />
