ROH - 09/08/14 <br />RESOLUTION NO. 2014 -32 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA APPROVING AND ADOPTING <br />AMENDMENTS TO THE BYLAWS OF THE PLANNING <br />COMMISSION OF THE CITY OF SANTA ANA <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. The powers and duties of the Planning Commission are specified in <br />Section 910 of the Charter of the City of Santa Ana and in Section 2 -350, <br />et seq., of the Santa Ana Municipal Code. <br />B. The City Charter requires that each board or commission prescribe rules <br />and regulations governing its operations. <br />C. The current Bylaws of the Planning Commission of the City of Santa Ana <br />are set forth in Resolution No. 01 -44, adopted September 24, 2001, as <br />amended by Resolution No. 2014 -24, adopted July 28, 2014. <br />D. On March 10, 2014, the Santa Ana City Attorney presented an ethics <br />seminar to the Planning Commission at which time the City Attorney told <br />the Planning Commissioners that the best practice for addressing ex parte <br />communications would be to require each Planning Commissioner to <br />submit written disclosure forms regarding ex parte communications. The <br />Planning Commission immediately began implementing this process and <br />later added the use of written disclosure forms as an amendment to the <br />Planning Commission Bylaws. <br />E. The Planning Commission desires to again amend its Bylaws herein. All <br />portions of Planning Commission Resolution No. 01 -44 and Planning <br />Commission Resolution No. 2014 -24 not revised by this resolution shall <br />remain in full force and effect. <br />F. All provisions of the Planning Commission Bylaws that are repeated herein <br />are repeated solely in order to comply with the provisions of Section 418 of <br />the City Charter. Any such restatement of existing provisions of the Bylaws <br />is not intended, nor shall it be interpreted, as constituting a new action or <br />decision of the Planning Commission, but rather such provisions are <br />repeated for tracking purposes only in conformance with the Charter. <br />
