D. APPLICATION OF FEES <br />When development fees are collected at the time of <br />building permit issuance, the number of residential <br />units or area of non - residential buildings will be <br />known. The fees for each development will simply be <br />calculated by multiplying the number of residential <br />units or gross floor area of non - residential buildings <br />times the appropriate land use category and the fee <br />zone. Gross floor area shall be defined as total <br />floor area including each floor of multiple story <br />buildings within the outer footprint of the building <br />as described on the building permit. Adjustments will <br />not be made to traffic generation rates to reflect <br />anomalies due to project design or other conditions. <br />All land uses will be determined to be within the most <br />appropriate of the three general land use categories. <br />In the event an existing non - residential building is <br />proposed to be expanded, the fee will be determined by <br />the net increase of building area. If a <br />non - residential building is converted to another <br />non - residential use with no net increase in building <br />area, no fees shall be required. Parking structures <br />shall also be exempt from payment of fees since they <br />do not generate a vehicular attraction in and of <br />themselves. <br />The following categories which receive exemptions from <br />payment of property taxes will also be generally <br />exempt from paying transportation corridor fees: <br />(1) Church; (2) Religious; (3) College; (4) Welfare; <br />(5) Wholly Exempt; (6) Other. The final determination <br />of whether a property is exempt will be based upon <br />verification of a property tax exemption for those <br />specified categories on the latest Assessor's roll as <br />defined for Orange County by the State of California. <br />Government -owned facilities or utilities shall be <br />exempt from payment of fees to the extent that the <br />facilities will not be used for generating revenue or <br />commercial purposes. Examples of exempt public uses <br />are city halls, park buildings, and other public <br />buildings. Privately owned utilities will not be <br />exempt from payment of corridor fees. <br />Notwithstanding property tax exemptions, <br />governmental -owned or constructed facilities <br />(including but not limited to counties, cities and <br />
