Grosse, Executive Dire lu <br />From: Public Works Agengy _ <br />Subject: FIRST AMENDED AND RESTATED 0TNT _ExF=sE OF pcwTzC arRFFMPnrr inn mrlp SAXT <br />JOAQUIN HILLS AND FOOTHILL /EASTERN TRANSPORTATION CORRIDOR AGENCIES <br />STATEMENT OF THE ISSUE <br />The County of Orange, the City of Santa Ana and ten other Orange County Cities <br />that would benefit from the construction of the San Joaquin Hills and Foothill/ <br />Eastern Transportation Corridors are members of the Transportation Corridor <br />Agency. At their September 15, 1988 Board Meeting, the Directors of the San <br />Joaquin Hills and Foothill/Eastern Transportation Corridors were notified by <br />counsel that there would be a request by each of the participating agencies to <br />review and execute the First Amended and Restated Joint Powers Agreement. This <br />amendment is urgently needed by the October 13, 1988 Board Meeting to issue <br />bonds to commence design of the three corridors. <br />One of the major changes to the Joint Powers Agreement is that the amended <br />agreement will state that toll revenue is one of the legally feasible methods of <br />financing for the Agency. The agreements further acknowledge statutory author- <br />ity relating to Caltrans' future maintenance of toll collection facilities. <br />Other changes to the agreement include the addition of the City of Mission Viejo <br />as one of its parties, the currently adjusted fee schedule for the thoroughfare <br />and bridge fee program, a broadening of the power of the Board to appoint Ex- <br />Officio members. This last provision will provide a means of including corri- <br />dor communities which may become incorporated. <br />Under the provisions of the existing agreements, 3/4 of all parties must approve <br />the amendments. The amendments as reviewed by staff, more effectively establish <br />the provisions of the Joint Powers Agreements between the cities that belong to <br />the Agency. Therefore, the recommendation of staff is that the City Council <br />authorize the Mayor to execute the revised Joint Exercise Powers Agreement for <br />both the San Joaquin Hills and Foothills/Eastern Transportation Corridor <br />Agencies. <br />ALTERNATIVES CONSIDERED <br />The alternative is not to approve the amendments to the agreement. This alter- <br />native is not recommended since it would not enable the Agency to finance the <br />facilities from toll road revenue. <br />FISCAL IMPACT <br />There is no direct fiscal impact on the City of Santa Ana. <br />Authorize the Mayor to executive the First Amended and Restated Joint Exercise <br />of Powers Agreement for the San Joaquin Hills and Foothill/Eastern Transporta- <br />tion Corridor Agencies. <br />David H.
