SECOND AMENDED AND RESTATED <br />JOINT EXERCISE OF POWERS AGREEMENT <br />CREATING THE SAN JOAQUIN HILLS <br />TRANSPORTATION CORRIDOR AGENCY <br />THIS SECOND AMENDED AND RESTATED AGREEMENT is made and entered <br />into, pursuant to Sections 11.1 and 11.3, by and among the following public agencies as of the <br />_ day of ' 200_, the date on which ten or more of the following public agencies <br />executed this Second Amended and Restated Joint Exercise of Powers Agreement Creating the <br />San Joaquin Hills Transportation Corridor Agency: <br />a. County of Orange <br />b. City of Aliso Viejo <br />C. City of Costa Mesa <br />d. City of Dana Point <br />e. City of Irvine <br />f. City of Laguna Hills <br />g. City of Laguna Niguel <br />h. City of Laguna Woods <br />City of Mission Viejo <br />j. City of Newport Beach <br />k. City of San Clemente <br />City of San Juan Capistrano <br />m. City of Santa Ana <br />RECITALS <br />A. The California State Legislature adopted Chapter 708, Statutes 1984, adding <br />Section 66484.3 to the Government Code authorizing the County of Orange and any city within <br />the County of Orange to require by ordinance the payment of a fee as a condition of approval of <br />a final map or as a condition of issuing a building permit, for the purpose of defraying the actual <br />or estimated cost of constructing bridges over waterways, railways, freeways, and canyons or <br />constructing major thoroughfares. <br />B. The Parties to this Agreement have territorial jurisdiction within the Area of <br />Benefit of the San Joaquin Hills Transportation Corridor, and desire to impose such a fee <br />222571_7.DOC <br />
