Land uses were combined into three general land use categories (2 residential and <br />1 non- residential) for the purposes of applying fees to development projects. <br />Presently, as of June 12, 1997, fees for each of the fee zones within the Areas of Benefit are: <br />Single Family <br />Multi -Unit <br />SJHTC* Residential <br />Residential Non - Residential <br />Zone $3,133 /unit <br />$1,824 /unit $4.20 /sf. <br />Zone B $2, 426 /unit <br />$1, 416 /unit $3.11 /sf. <br />F/ETC ** <br />Zone A $3,673 /unit $2,144 /unit $5.10 /sf. <br />Zone B $2,612 /unit $1,520 /unit $2.96/sf. <br />* The foregoing SJHTC fee rates shall be increased on July 1, 1998, and annually thereafter, by <br />2.667% without further action by the Board. <br />** The foregoing F/ETC fee rates shall be increased on July 1, 1998, and annually thereafter, by <br />2.206 % without further action by the Board. <br />Developers who are required to construct portions of the transportation corridors will receive <br />credit for that work toward the payment of their fees by the Transportation Corridor Agency <br />pursuant to approved plans, specifications and phasing of the Agency, or by agreements with <br />Parties executed prior to the effective date of the First Amended and Restated Joint Exercise of <br />Powers Agreement creating the SJHTCA or the F/ETCA, as appropriate. The amount of credit <br />neither will be adjusted with subsequent revisions to the fee program nor will additional fees <br />based upon such subsequent revisions be required once such credit is memorialized by <br />agreement. This credit may be transferred in accordance with the provisions of Section XI to <br />subsequent owners of the property from which the credits were generated. <br />Payment of fees for residential multi -unit rental projects may be deferred for a period of five <br />years from issuance of a building permit. The developer must enter into an agreement to pay the <br />fee in effect at the time payment is due and provide a security in the amount of the fee plus 15 %. <br />Properties which are exempt from payment of property taxes will generally be exempt from <br />payment of corridor fees. Governmental owned and constructed facilities and utilities will be <br />exempt unless the facility is used for commercial or revenue generating purposes. <br />Portions of seventeen cities are included within the benefit areas for the SJHTC and F /ETC in <br />addition to portions of the unincorporated County of Orange.
