m. "SJH Agency" means the San Joaquin Hills Transportation Corridor <br />Agency formed by the parties to the SJH Agreement. <br />n. "SJH Agreement" means that certain Second Amended and Restated Joint <br />Exercise of Powers Agreement Creating the San Joaquin Hills Transportation Corridor Agency. <br />II. <br />PURPOSE AND POWERS <br />2.1 Agency Created. <br />There is hereby created a public entity to be known as the <br />"FOOTHILUEASTERN TRANSPORTATION CORRIDOR AGENCY." The Agency is <br />formed by this Agreement pursuant to the provision of Article 1, Chapter 5, Division 7, of Title I <br />of the Government Code of the State of California. The Agency shall be a public entity separate <br />from the parties hereto. <br />2.2 Purpose of the Agreement Common Powers to be Exercised. <br />Each Party has the common power to plan for, acquire, construct, maintain, <br />repair, manage, operate, and control facilities for one or more of the following purposes: <br />a. The financing of and the imposing of fees for the planning and <br />construction of major thoroughfares and bridges; <br />b. The power to plan for, acquire, and construct environmentally - sensitive <br />thoroughfares and bridges to conform to the technical standards of the California Department of <br />Transportation (CALTRANS) and the Federal Highway Administration (FHWA) whenever <br />possible. <br />The purpose of this Agreement is to jointly exercise the foregoing common <br />powers to undertake such studies and planning relative to the Foothill and Eastern Transportation <br />Corridors as may be necessary to establish Areas of Benefit, to recommend to the Parties the <br />adoption of local ordinances and the undertaking of all acts necessary for the imposition of fees <br />by the Parties pursuant to Government Code Section 66484.3 and to fund, plan, acquire, and <br />construct the major thoroughfares and bridges in the Foothill and Eastern Transportation <br />Corridors. Except for maintenance of the facilities relating to collection of tolls and insuring that <br />the major bridges or thoroughfares constructed pursuant to this Agreement comport to those <br />design elements incorporated into Interstate 280 near the San Francisco Bay Area, the Agency <br />shall not maintain or operate, or incur liability for the maintenance or operation of the facilities <br />constructed pursuant to this Agreement, except as otherwise provided herein. <br />Board planning policy has and shall continue to respond to those various <br />memoranda of understanding, resolutions, minute orders and policy statements of Parties, <br />attached as Exhibit "A" to the prior form of this Agreement and collectively incorporated in the <br />"Issues Inventory Manual" adopted by the Board on August 13, 1987. <br />0 <br />
