r 41"'MWc+ME1 <br />RESOLUTION NO. 2014 -47 <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA APPROVING CONDITIONAL <br />USE PERMIT NO. 2014 -49 AS CONDITIONED TO <br />EXPAND AN EXISTING CARE HOME FACILITY, <br />VARIANCE NO. 2014 -07 AS CONDITIONED TO ALLOW A <br />REDUCTION IN BUILDING SETBACKS, AND VARIANCE <br />NO. 2014 -08 AS CONDITIONED TO ALLOW A SIX FOOT <br />HIGH FRONT YARD FENCE FOR THE PROPERTY <br />LOCATED AT 325 THROUGH 403 NORTH SUSAN <br />STREET <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA <br />AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Applicant is requesting approval of Conditional Use Permit No. 2014 -49 to <br />expand an existing care home facility, Variance No. 2014 -07 to allow a <br />reduction in building setbacks, and Variance No. 2014 -08 to allow a six <br />foot high front yard fence at 325 through 403 North Susan Street. <br />B. Conditional Use Permit No. 2014 -49, Variance No. 2014 -07, and Variance <br />No. 2014 -08 came before the Planning Commission of the City of Santa <br />Ana for a duly noticed public hearing on December 8, 2014, to consider all <br />testimony, written and oral. <br />C. Conditional Use Permit No. 2014 -49 has been filed with the City of Santa <br />Ana seeking to allow the expansion of an existing care home facility <br />1. Section 41- 247.5(b) of the Santa Ana Municipal Code requires a <br />conditional use permit for care homes in the R2 district. <br />2. This site contains seven buildings: five residential structures, an <br />administrative office, and meeting room functions. A conditional use <br />permit is needed to expand the existing John Henry Foundation care <br />facility to incorporate two existing residential structures to the south. <br />3. Santa Ana Municipal Code Section 41 -638 authorizes the Planning <br />Commission to grant a conditional use permit upon making certain <br />findings. <br />Resolution No. 2014 -47 <br />Page 1 of 12 <br />31A-26 <br />
