BRISTOL STREET, SANTA ANA, CA <br />APN: 405 - 252 -20 <br />Dear Property Owner: <br />The City of Santa Ana ( "City ") is proceeding with its plans to construct Phase IIIB of the <br />Bristol Street Widening Project between Washington Avenue and Seventeenth Street. The <br />City obtained a preliminary title report that lists McDonald's Corporation, DBA Delaware <br />McDonald's Corporation successor in interest by merger to franchise realty interstate <br />corporation, an Illinois Corporation, as to parcels C and D & McDonald's corporation, a <br />Delaware Corporation, as to parcels A and B, to be the vested owners of the above - <br />mentioned property. The City seeks to acquire a portion of the property located at the <br />above - mentioned address, which consists of the underlying real property of 4,550 square <br />feet and the improvements thereon, as described in Attachment 1. The area to be acquired <br />is referred to herein as the "Property ". <br />Based on McDonald's Corporation's desire to reconfigure and re -build on the remainder of <br />their site, the City rescinds and replaces the City's Offer to acquire the entire property dated <br />October 1, 2013 and makes an offer for a partial take instead which contemplates the <br />relocation of McDonald's onsite. THIS OFFER IS CONTINGENT ON THE PARTIES <br />REACHING AGREEMENT AS TO THE VALUE OF THE PARTIAL TAKE AND <br />CONCURRENT AGREEMENT TO RECONFIGURE AND REBUILD ON SITE. Due to <br />project schedule constraints, the City needs an answer to this concept within 30 days. If <br />McDonalds is agreeable to this concept, the parties will need to meet immediately to finalize <br />the timeline required to reach a final resolution. The City needs to begin construction by <br />March 2015 and therefore time is of the essence in terms of reaching a final agreement. If <br />the City and McDonald's cannot come to an agreement regarding the partial take <br />acquisition, the City reserves the right to acquire the entire site for construction of the street <br />improvement project and a new offer will be made consistent with a full take. <br />75A -6 <br />
