Adopt an ordinance amending the <br />Santa Ana Municipal Code and adopt <br />Resolution adjusting administrative fines <br />February 17, 2015 <br />Page 3 <br />certificate of occupancy, or is not operating in accordance with the certificate of <br />occupancy, this ordinance confirms the City's ability to disconnect the utilities to such <br />business until compliance with the certificate of occupancy requirements is obtained. Non- <br />compliant businesses pose a threat to the health and safety, and well being of the public <br />and to the business owners' and employees because they are operating in violation of the <br />SAMC; example, an auto parts store operating as an auto repair shop without the proper <br />inspection and certificate of occupancy. Although the SAMC currently allows for the <br />disconnection of utilities in relation to a certificate of occupancy, the proposed Ordinance <br />confirms and reinforces the Community Preservation Division's enforcement efforts on this <br />point. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's efforts to meet Goal No. 1 Community Safety, Goal No. 3 <br />Economic Development, Goal No. 4 Government Financial Stability, and Goal No. 5 Community <br />Health, Livability, Engagement and Sustainability. <br />FISCAL IMPACT <br />Approval of the proposed ordinance will increase the City's ability to recover enforcement costs <br />related to Santa Ana Municipal Code violations and the proposed resolution will increase the <br />administrative fines collected as a result of those violations. If approved, the increase in revenue <br />for the General Fund will create a beneficial impact for the City; however, the amount of revenue <br />will vary from year to year depending on the number of code violations and how they are <br />enforced. <br />Vince C.
