City Clerk's Office <br />Santa Ana City Council <br />20 Civic Center Plaza <br />Santa Ana, CA 92701 <br />2915 FEtg 10 AI`I 9' 24 <br />CITY OF SANTA P,Nf /'t <br />CLERK OF i'U,-. :,, <br />Re: Proposed Sewer and Water fees <br />To: Honorable Council Members, Mayor: <br />As a homeowner and resident I am writing to oppose the sewer, <br />water fee increases, and the Capital Recovery and Lateral fees, that may <br />be imposed as an incident of property ownership. <br />First, Proposition 218 (Articles XIII C & D California Constitution) <br />requires local governments to mail a ballot whereby the owner may <br />indicate his /her support or opposition to the proposed assessed fees. The <br />city merely mailed a letter requesting property owners send a "written <br />protest" to the City Clerk if they oppose the fees. Property owners failing to <br />respond to the city's letter, would be counted as supporting the proposed <br />increased fees This procedure is illegal and not in compliance with <br />Proposition 218. In 2006, the California Supreme Court ruled provisions of <br />Prop 218 apply to local water and sewer charges. <br />The city's letter confuses residents with gibberish, and no specifics on <br />proposed improvements and duration of payments. No neighborhood <br />meetings were held to inform homeowners and residents on the proposed <br />projects and related costs. <br />As the city is not in compliance with Proposition 218, the City Council <br />must reiect the proposed water /sewer fee and Capital Recovery and <br />Lateral repair fee proposal. <br />Sincerely, <br />75A -68 <br />
