August 27, 2014 Bowers Museum, SSA Project #14048 <br />SALLY SWANSON <br />ARCHITECTS, INC. <br />All newly constructed places of public accommodation and commercial facilities must be accessible <br />to individuals with disabilities to the extent that it is not structurally impracticable. For additions and <br />alterations, the new construction requirements apply to any facility occupied after January 26, 1993, <br />for which the last application for a building permit or permit extension is certified as complete after <br />January 26, 1992. According to the DOJ, full compliance will be considered "structurally impracticable" <br />only in those rare circumstances when the unique characteristics of terrain prevent the incorporation <br />of accessibility features (e.g., marshland that requires construction on stilts). <br />If an entity constructs or alters the required elements of the path of travel in accordance with the 1991 <br />ADA Standards or the UFAS before March 15, 2012, then the entity is not required to retrofit any such <br />elements included in the 2010 ADA Standards solely because of an alteration to a primary function <br />area served by a path of travel. In accordance with the California Building Standards Code <br />requirements, a project must comply with the code underwhich that portion of the work was permitted <br />and inspected and of which also received a final certificate of occupancy or other approval. Certain <br />'grandfather' considerations are already being addressed with regards to compliance with the 2010 <br />CBC, the emergency adoptions by the CBSC in August 2013, and the issuance of the new 2013 CBC <br />requirements (effective January 1, 2014). <br />August 27, 2014 SSA Project #14048 Page 10 of 28 <br />
