REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 17, 2015 <br />TITLE: <br />CONDITIONAL USE PERMIT NO. 2014 -53 <br />TO ALLOW A TYPE 41 ALCOHOLIC <br />BEVERAGE CONTROL LICENSE AT 828 PHO <br />RESTAURANT AT 220 WEST FIRST STREET, <br />SUITE 103 - YEN DANG, APPLICANT <br />(STRATEGIC PLAN NOS. 3, 2; 3, 4) <br />11 CITY MANAGE <br />RECOMMENDED ACTION <br />CLERIC OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1" Reading <br />❑ Ordinance on 200 Reading <br />Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Conditional Use Permit No. 2014 -53. <br />PLANNING COMMISSION ACTION <br />On February 23, 2015, the Planning Commission adopted a resolution approving Conditional <br />Use Permit No. 2014 -53 by a vote of 8:0 (Alderete absent) which approved a Type 41 Alcoholic <br />Beverage Control (ABC) license in order to sell beer and wine for on- premise consumption at <br />828 Pho Restaurant located 220 West First Street, Unit 103 in the Specific Development No. 40 <br />(SD -40) zoning district. The Planning Commission made no changes to the recommendation <br />outlined in the attached staff report (Exhibit A). <br />DISCUSSION <br />The 828 Pho restaurant is located within a shopping center on First Street between Broadway and <br />Sycamore Street, and has been in operation since 2008. The lot is developed with three <br />commercial buildings, with the 828 Pho restaurant occupying approximately 1,800 square feet of <br />a 4,071 square foot single -story commercial building. The applicant is requesting a Conditional <br />Use Permit for a Type 41 ABC license to provide an additional amenity with meals. The <br />restaurant contains all necessary equipment to be considered for a Type 41 ABC license. The <br />hours of operation for the restaurant are from 10:00 a.m. to 8:00 p.m. seven days per week. Full <br />sized site plans are available for public viewing in the Clerk of the Council Office. <br />STRATEGIC PLAN ALIGNMENT <br />Approval of this item supports the City's efforts to meet Goal No. 3 Economic Development, <br />Objective No. 2 (create new opportunities for business /job growth and encourage private <br />development through new General Plan and Zoning Ordinance policies) and Objective No. 4 <br />(continue to pursue objectives that shape Santa Ana into a thriving, culturally diverse, shopping, <br />dining and entertainment destination). <br />31 B -1 <br />
