3. Annual Plan Review <br />Plan Sponsor will receive an Annual Plan <br />Review in written presentation including, but not <br />limited to, the following information: <br />a) Detailed description of all new <br />services, service models, trends and <br />technology offered by Great -West to its <br />clients or within the industry; <br />b) Review of enrollment efforts; <br />c) Asset allocation information, <br />contributions, distributions (investment <br />options and fixed /variable split); <br />d) Voice response usage and <br />enhancements; <br />e) Benefit payments; <br />f) Direct online system access — current <br />services and available services; <br />g) Legislative updates; <br />h) Identified fees or charges revenue <br />collected from each investment fund by <br />investment fund option and where such <br />revenue has been paid for what services <br />including, but not limited to, <br />recordkeeping and fun management <br />services with total fund fee and charge <br />revenue' <br />i) Plan assets and expenses, with <br />weighted expense ratio, expenses shown <br />by separate service cost, including, but <br />not limited to, "12b -1" fees, "Sub -TA" <br />fees, fiduciary reimbursement <br />administration and respective <br />management fees, including investment <br />management fees with associated <br />percentage of Plan expenses; <br />j) Fixed fund charges, fees, subsidies <br />and any market -to -book value issues; <br />k) Total revenue to Great -West with <br />revenue shown by participant. <br />4. Annual Investment Performance Report <br />Great -West shall provide Plan Sponsor with an <br />annual investment performance report. <br />K. Regulatory Updates <br />Great -West shall periodically make information <br />available to Plan Sponsor concerning federal <br />legislative activity of which Great -West is aware that <br />may affect the Plan and related funding contracts. <br />Such information, however, does not constitute legal <br />or tax advice regarding the legal sufficiency of the <br />Plan. <br />L. Benefits, Tax Withholding and Reporting <br />Benefit payments to Participants and <br />beneficiaries will be made within two Business Days <br />following receipt by Great -West of complete payment <br />instructions. For the purposes of this Agreement, <br />"complete payment instructions" means that all <br />required information on the Participant request form, <br />whether paper or online, has been completed, <br />including all required signatures or authorizations, <br />and that Great -West has completed its review of the <br />request in accordance with the terms of this <br />Agreement. Benefit payments will be made, taxes <br />withheld, and tax reporting completed as follows: <br />1. A record will be maintained of each <br />distribution from the Plan with respect to the <br />Participant, including the reason for the <br />distribution. A report may be made available to <br />Plan Sponsor on request. <br />2. Federal and state income tax withholding <br />and tax reporting that is applicable at the time <br />of the distribution will be performed and sent to <br />the Participant or beneficiary for each benefit <br />payment from the Plan. <br />3. The income tax withholding will be forwarded <br />to the Internal Revenue Service and <br />appropriate state governmental entities, and <br />will be completed by the applicable due dates. <br />4. Information will be provided to the Internal <br />Revenue Service annually showing an <br />accounting of all Participants who have <br />received distributions during the previous <br />calendar year. A similar report will be provided <br />to Plan Sponsor. <br />M. Qualified Domestic Relations Orders <br />If the Plan accepts QDROs, Plan Sponsor hereby <br />instructs Great -West to complete an administrative <br />City of Santa Ana Services Agreement 401(a) 02 -02 -15 Page 9 <br />
