This letter shall be our agreement ("Letter Agreement") regarding the hearing officer services described below ("Services") to be provided by Barry A. Ross, Attorney at Law, a sole proprietorship ("Contractor"), as an independent contractor to the City of Santa Ana ("City") for the City's Uniform Administrative Appeal Hearings ("Project"). Contractor is retained as an independent contractor and is not an employee of the City. SERFicFs, SCif DuLE of PERFORaiANCE: The Services to be provided include the following: perform all necessary neutral and imbiased hearing officer services for the Project, in accordance with Chapter 3 of the Santa Ana Municipal Code and applicable state or federal law. Services on the Project shall begin immediately and shall continue on as as -needed basis through March 11, 2016, unless extended by the City in writing. It is expressly understood, acknowledged and agreed that Contractor is hired as a neutral and unbiased arbitrator. The City reserves the right to hire other neutral hearing officers to be assigned on an unbiased rotational basis to administrative appeals as they arise, and in no case shall City hire or assign hearing officers based upon the outcome of prior decisions. SmxoARD of Cim,, Contractor shall perform all Services under this Letter Agreement in a skillful and competent manner, consistent with the standards generally recognized as being employed by professionals in the same discipline in the State of California, and consistent with all applicable laws. Contractor represents that it, its employees and subcontractors have all licenses, permits, qualifications, and approvals of whatever nature that are legally required to perform the Services, including a City Business License, and that such licenses and approvals shall be maintained throughout the term of this Letter Agreement.
