Adept an ordinance approving Development Agreement No, 2015 -01. <br />2, Adopt a resolution approving Site Plan Review No. 2015 -02 as conditioned. <br />Approve and adopt an addendum to the Mitigated Negative Declaration and Mitigation <br />Monitoring Program, Environmental Review No. 2011 -45. <br />PLANNING COMMISSION ACTION <br />At its regular muting on March 23, 2015, by a vote of 6:0 (Bacerra absent), the Planning <br />Commission held a public hearing and recommended that the City Council direct the City <br />Manager to authorize the assignment and amendment of Development Agreement No. 2012 -01 <br />(DA No. 2015 -01) to Legado at The Met, LLC with such non - substantive changes as may be <br />approved by the City Manager and City Attorney; adopt a resolution approving Site Plan Review <br />No, 2015 -02 as conditioned; and approve and adopt an addendum to the Mitigated Negative <br />Declaration and Mitigation Monitoring Program, Environmental Review No. 2011 -40. The <br />Planning Commission made no changes to the terms of the agreement as outlined in the <br />attached staff report (Exhibit A). <br />Legado Companies is requesting approval to amend an existing development agreement and site <br />plan review to allow the construction of a 204 -unit multi - family apartment community consisting of <br />six five -story buildings over a podium parking garage on a 3,1 -acre site at 200 East First American <br />Way.
