EXHIBIT D <br />ESSENTIAL USE CERTIFICATE <br />Holman Capital Corporation <br />29883 Santa Margarita Parkway, Suite 100 <br />Rancho Santa Margarita, CA 92688 <br />May 22, 2015 <br />Re: Equipment Lease- Purchase Agreement dated May 22, 2015 <br />1, David Cavazos, the City Manager of the City of Santa Ana, as lessee (the 'Lessee "), am qualified to <br />answer the questions set forth below regarding the Equipment to be acquired by Lessee in connection <br />with the above - referenced Lease Agreement: <br />IVhat is the specific use of the Equipment? <br />Financing of the Partnership Costs owed to the County of Orange would allow the City and it's recently <br />purchased equipment to access the 800 MHz communication system and improve the reliability of <br />communication related to any public safety incidents within the cotmty or in the event of a natural <br />disaster. <br />Equipment used under the 800 MHz system is used for radio communications by the Police and Fire <br />Agencies for emergency and non- emergency daily operations, special events, and inter - agency <br />communications during mutual aid situations and potentially catastrophic events. It provides the same <br />interoperable capabilities for Public Works and Lifeguard Agencies, as well. The use of the 800 MHz <br />Countywide Coordinated Corrununications System (CCCS) is achieved through a Partnership with <br />Orange County Police, Fire, Public Works and Lifeguard Agencies. <br />2. Wheat increased capabilities will the Equipment provide? <br />The Orange County 800 MHz CCCS services communications and interoperability, requirements <br />of all County and City Public Safety agencies in Orange County. The existing system is outdated, <br />and to extend the useful service life of the system a systematic replacement of critical <br />infrastructure and electric equipment is required. Replacement and /or upgrades to both hardware <br />and software will be required to maintain a state -of -the -art system and to extend the life of this <br />valuable infrastructure. The system will provide the same quality capabilities with Next <br />Generation technology that helps agencies provide for the safety and well -being of their <br />communities. <br />GVhy is the Equipment essential to your ability to dellvea• governmental services? <br />Financing of the Partnership Costs owed to the County of Orange would allow the City and it's recently <br />purchased equipment to access the 800 MHz communication system and improve the reliability of <br />conmrunication related to any public safety incidents within the county or in the event of a natural <br />disaster. <br />The 800 MHz CCCS provides critical interoperable communication needs for all Police, Fire, Public <br />Works and Lifeguard Agencies during normal operations, and in the event of a natural disaster. <br />Maintaining state -of- the -art radio communication technology is essential to the efforts of community <br />safety. <br />D -1 <br />WCSR 339735920 <br />55A -27 <br />
