MOTION: Authorize the City Manager and Clerk of the Council to <br />execute an agreement with California Professional Engineering, Inc., <br />expiring on June 30, 2016, to rewire existing high -voltage streetlights <br />and install LED post top fixtures in an amount not to exceed <br />$498,020, subject to nonsubstantive changes approved by the City <br />Manager and City Attorney. <br />25E. AGMT NO. 2015-091 SPECIAL LEGAL COUNSEL SERVICES <br />RELATED TO LEGAL CHALLENGES OF MEDICAL MARIJUANA <br />INITIATIVE (MEASURE BB) {STRAGIC PLAN NOS. 1,3,4;5} ='° City <br />Attorney's Office <br />Councilmember Martinez, noted that no general funds have been <br />expended. <br />City Attorney Carvalho, clarified that matter represents 7 lawsuits <br />challenging initiative, may take 2-4 years before they are resolved and <br />require additional funding to litigate; medical marijuana fund has $320,000 <br />and designated staff in anticipation of lawsuits; regulatory permits being <br />processed thus the City will receive additional revenues. <br />City Manager Cavazos, indicated that all revenue generated are used on <br />operations including enforcement; revenue and expenses forecasted. <br />Mayor Pro Tern Sarmiento, agreed that lawsuits were anticipated; City <br />Council had discussions on the subject matter in addition to enforcement <br />issues that come from regulating new industry. <br />Councilmember Tinajero, agreed with Mayor Pro Tem and <br />Councilmember Martinez; reminded all that taxes may be amended, if <br />needed. <br />Mayor Pulido, reminded all that matter approved by 4-3 vote; requested <br />reported on status and cost of enforcing illegal operators in Santa Ana. <br />MOTION: Authorize the City Manager and the Clerk of the Council to <br />execute an agreement with Richards, Watson & Gershon, APC, <br />subject to nonsubstantive changes approved by the City Manager <br />and City Attorney, for a three-year term ending May 19, 2018, with <br />provisions for one one-year extension, exercisable by the City <br />Manager and the City Attorney for an amount not to exceed $500,000. <br />MOTION: Sarmiento <br />VOTE: AYES: <br />SECOND: Tinajero <br />Amezcua, Benavides, Martinez, Pulido, <br />Reyna, Sarmiento, Tinajero (7) <br />CITY COUNCIL MINUTES 15 MAY 19, 2015 <br />
