FRANCHISES: IN GENERAL. The term "the streets of <br />the City" as used In this Article shill include streets, .ways, alleys, <br />avenues, highways, boulevards, concourses, driveways, br:dgec,'p&rks, <br />parkways, end public grounds or waters within or belonging to the City. <br /> <br /> Subject to the provisions of this Charter, the City Council shell hive <br />the power in behalf of the City to grant franchises or rights or make <br />contracts providing for tho furnishing of the City and its Inhabitants with <br />transportation, communication, terminal facilities, water, light,, heat, <br />power, refrigeration and storage, or ~ny other public utility or service, or <br />using the streets of the City for the operation of plants, works, or equip. <br />meat for the furnishing thereof, or traversing any portion of the streets <br />of the City for the transmitting ar conveying of any such service <br />elsewhere. <br /> <br /> The City Council may grant a franchise to any person, firm, or cot- <br />potation, whether operating under an existing franchise or nnt, and may <br />prescribe the terms and conditions of any such great. The City Council <br />may .also provide, by procedural ordinanc.e, the method of procedure end <br />addihonal terms and conditions for makmg such grants, subject to the <br />provisions of this Charter. <br /> <br /> No grant of any franchise may be transferred or assigned by the <br />grantee except by consent in writing of the City Council and unless the <br />transferee or ~essignee thereof shell covenant end agree to perform end <br />bo bound by each and ell of the terms and conditions imposed in the <br />grant or by procedure1 ordinance sad by this Charter. <br /> <br /> The City may issue permits for the construction of spur or side <br />tracks in and over the streets of the City end the running of cars thereon <br />for the purpose of connecting warehouses, factories, or other business <br />industries and enterprises with soy line of railroad within tho City, upon <br />such terms and subject to such regulations and conditions es shell be <br />prescribed from time to time by ordinance. Such tracks shall be used for <br />the transportation of freight only and shall not be used es a main line or <br />part thereof. Such tracks must be laid end operated in such manner and <br />under such restrictions as not to interfere with the use of the streets of <br />the City by the public. All such permits shall be revocable at the <br />pleasure of the City Council, <br /> <br /> Section 1301. FRANCHISES: TERMS OF FRANCHISES.
