A -2015 -009 <br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />CLERK OF COUNCIL <br />DATE, ✓i$ l5 FIRST AMENDMENT TO CUSTODIAL SERVICES AGREEMENT <br />THIS FIRST AMENDMENT TO AGREEMENT, made acid entered into this 0 day of <br />a"A 2015, by and between ABM Onsite Services West, Ire., a California <br />corporation ( "Contractor "), and the City of Santa Ana, a charter city and municipal corporation <br />organized and existing under the Constitution and laws of the State of California ( "City "), <br />RECITALS <br />A. City and Contractor entered into Agreement #A- 2014 -106, dated June 1, 2014, for a <br />contractor having special skill and knowledge in the field of janitorial and custodial <br />services ( "said Agreement "). <br />B. In accordance with the terns and conditions of said Agreement, the Parties desire to add <br />to the scope of services and increase the compensation in said Agreement. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions of said Agreement, except as herein modified, the parties agree as follows: <br />Section 1, SCOPE OF SERVICES, shall be amended to add five (5) new locations in <br />Districts 2 and 4, and revise the scope of one (1) existing location in District 3, for park <br />building custodial services, as set forth in Exhibit A attached hereto and incorporated <br />herein by this reference. <br />2. Section 3, COMPENSATION, the relevant portion of said section shall be amended to <br />increase the annual compensation of $138,336.00 by $15,054.88, which includes a 5% <br />contingency amount, such that the total annual amount to be expended under said <br />Agreement shall not exceed $153,390.88 during the initial one (1) year term of said <br />Agreement, which pursuant to the terms of said Agreement terminates on May 31, 2015, <br />unless terminated earlier pursuant to the terms of said Agreement. <br />The relevant portion of said section shall also be amended to increase the annual <br />compensation of any renewal period by $28,763.46, which includes a 10% contingency <br />annount, such that the total annual amount to be expended under said Agreement shall not <br />exceed $167,099.46 during any renewal year of said Agreement. <br />3. Except as hereinabove modified, all terms and conditions of said Agreement shall remain <br />in iinll force and effect. <br />1!{ <br />
