d. Exclusion of owner claims against HUD <br />Nothing in the HAP contract shall be construed as creating any right of the owner <br />to assert any claim against HUD. <br />18. PHA -OWNED UNITS <br />Notwithstanding Section 17 of this HAP contract, a PHA may own units assisted under <br />the project -based voucher program, subject to the special requirements in 24 CFR 983.59 <br />regarding PHA -owned units. <br />19. CONFLICT OF INTEREST <br />a. Interest of members, officers, or employees of PHA, members of local <br />governing body, or other public officials <br />No present or former member or officer of the PHA (except tenant - <br />commissioners), no employee of the PHA who formulates policy or <br />influences decisions with respect to the housing choice voucher program <br />or project -based voucher program, and no public official or member of a <br />governing body or State or local legislator who exercises functions or <br />responsibilities with respect to these programs, shall have any direct or <br />indirect interest, during his or her tenure or for one year thereafter, or in <br />the HAP contract. <br />2. HUD may waive this provision for good cause. <br />b. Disclosure <br />The owner has disclosed to the PHA any interest that would be a violation of the <br />HAP contract. The owner must fully and promptly update such disclosures. <br />C.
