IEtlre incident is potentially a iminal, the faoility shall ensare that it <br />is promptly referred to an appropriate law enforcernent agency having Jurisdiction for <br />investigation. <br />TRAINING AND EDUCATION <br />115,31 Staff tralnW , <br />(1) The agency shall train, or require the training of, all employees who may have contact with <br />immigration detainees, and all facility staff, to be able to fulfill their responsibilities raider this <br />part, including training on; <br />(a) The agency's and the facility's zero -tolerance policies for all forms of sexual abuse; <br />(b) The right Of detainees and staff to be fkee from sexual abuse, and from retaliation for <br />reporting sexual abuse; <br />(c) Definitions and examples of prohibited and illegal sexual behavior; <br />(d) Recognition of situations where sexual abuse may occur; <br />(e) Recognition of physical, behavioral, and emotional signs of sexual abuse, and methods of <br />Preventing and responding to such occurrences; <br />(f) Flow to avoid inappropriate relationships with detainees; <br />(g) flow to cormnmicate effectively and professionally with detainees, including lesbian, <br />gay, bisexual, transgender, intersex, or gender nonconforming detainees; <br />(h) Procedures for reporting knowledge or suspicion of sexual abuse; and <br />(i) The requirement to limit reporting of sexual abuse to personnel with a necd-to-know in <br />order to make decisions concerning the victiva's welfare and for law enforcement or <br />investigative purposes. <br />(2) All current facility staff, and all agency employees who may have contact with immigration <br />detention facility detainees, shall be trained within one year of May 6, 2014, and the agency or <br />facility shall provide refresher information every two years. <br />(3) The agency and each facility shall document that staff that may have contact with immigration <br />facility detainees have completed the training. <br />115.32 Otlrer training. <br />(1) The facility shall ensure that all volunteers and other contractors (as defined in paragraph (4) of <br />this section) who have contact with detainees have been trained on their responsibilities under the <br />agency's and the facility's sexual abuse prevention, detection, intervention and response policies <br />and procedures. <br />(2) The level and type of training provided to volunteers and other contractors shall be based on the <br />services they provide and level of contact they have with detainees,, but all volunteers and other <br />contractors who have contact with detainees shall be notified of the agency's and the facility's <br />zero -tolerance policies regarding sexual abuse and informed how to report such incidents. <br />(3) Each facility shall receive and maintain written eonfumiation that volunteers and other contractors <br />who have contact with immigration facility detainees have completed the training. <br />(4) In this section, the term other contractor means a person who provides services on a non- <br />recurring basis to the facility pursuant to a contractual agreement with the agency or facility. <br />115,33 Detaigee education. <br />(1) During the intake process, each facility shall ensure that the detainee orientation program notifies <br />and informs detainees about the agency's mid the facility's zero -tolerance policies for all forms of <br />sexual abuse and includes (at a minimlun) instruction on; <br />
