Other Cost Requirements <br />Consolidation of Law Enforcement Terrorism Prevention Activities (LETPA) <br />Per section 2006 of the Homeland Security Act of 2002 (Public Law 107 -296), as <br />amended, (6 U. S.C, § 607), States are required to ensure that at least 25 percent <br />(25 %) of the combined FISGP funds allocated under SHSP and UASI are dedicated <br />towards law enforcement terrorism prevention activities. The LETPA allocation can <br />be from SHSP, UASI or both. This requirement does not include award funds from <br />OPSG, Please refer to Appendix A — FY 2014 Program Allocations for LETPA <br />minimum allocations for SHSP and UASI by jurisdiction. <br />The National Prevention Framework describes those activities that should be <br />executed upon the discovery of intelligence or information regarding an imminent <br />threat to the homeland, in order to thwart an initial or follow on terrorist attack, and <br />provides guidance to ensure the Nation is prepared to prevent, avoid, or stop a <br />threatened or actual act of terrorism. Activities outlined in the National Prevention <br />Framework are eligible for use of LETPA focused funds. In addition, where <br />capabilities are shared with the protection mission area, the National Protection <br />Framework activities are also eligible. Other terrorism prevention activities proposed <br />for funding under LETPA must be approved by the FEMA Administrator. <br />SIISP and UASI Pass - Through Requirements <br />Awards made to the SAA for HSGP carry additional pass through requirements. Pass <br />through is defined as an obligation on the part of the States to make funds available to <br />local units of government, combinations of local units, or other specific groups or <br />organizations. The State's pass through requirement must be met within 45 days of <br />the award date. Four requirements must be met to pass through grant funds: <br />• There must be some action to establish a firm commitment on the part of the <br />awarding entity; <br />• The action must be unconditional on the part of the awarding entity (i.e., no <br />contingencies for availability of SAA fiords); <br />• There must be documentary evidence of the commitment; and <br />• The award terms must be communicated to the official grantee <br />The SAA must obligate at least 80 percent (80 %) of the Rinds awarded under SHSP <br />and UASI to local units of government within 45 days of receipt of the funds. The <br />signatory authority of the SAA must certify in writing that these obligations have <br />been met. A letter of intent (or equivalent) to distribute funds is not considered <br />sufficient. Award sub- recipients must receive their funds within 45 days from the <br />date the funds are first made available to the grantee so that they can initiate <br />implementation of approved investments.
