date of his or her termination, not to exceed a maximum limit of <br />1066 hours, at the rate of base pay effective on the date of such <br />termination. <br />5. CASA members who notify the City, in writing, of Iheir intent to <br />retire within 12 calendar months from the date of retirement <br />shall be allowed to cash out any eligible sick leave bank <br />balances (K.1, K.3 and K.3.), upon request. Employees shall <br />receive payment as soon as practical, and no longer than 30 <br />days after the request has been made. If the employee cashes <br />out his or her eligible sick leave bank balances prior to <br />retirement and subsequently does not retire from the City, all <br />future sick leave accrual for the employee shall be subject to <br />the some cash out provision elected and will be processed on <br />the final paycheck. All combined cash outs cannot exceed <br />what the employee would have been entitled to if the cash out <br />was processed on the final paycheck only. <br />11.2 Bereavement Leave. <br />A. An employee covered under this MOU shall be granted up to three (3) <br />working days leave without loss of pay in the case of a death of a <br />member of the employee's immediate family. Such leave is <br />designated as bereavement leave. "Immediate family" as used in this <br />section is limited to: <br />Any member of the employee's household related by blood or <br />marriage; <br />A parent, parent -in -law, stepparent, spouse, child, brother, sister, <br />stepbrother, stepsister, grandparent or grandchild of the <br />employee, regardless of residence; <br />3. Any other relative of the employee by blood or by marriage <br />where it can be established by the employee that as a result of <br />such relative's death, the employee's presence is required to <br />handle funeral arrangements and /or matters of estate. <br />Whenever an employee is required to travel one way more than 500 <br />miles to attend to the death of a member of the employee's <br />immediate family, an employee may use up to sixteen (16) hours of <br />CONFIDENTIAL ASSOCIATION OF SANTA ANA(CASA) MOU: 2015 -2017 Page 48 <br />25G -50 <br />
