ARTICLE III <br />3.0 IMPLEMENTATION <br />3.1 The parties agree that this MOU shall not be binding upon the parties until the <br />City Council: <br />A. Acts, by majority vote, to formally approve this MOU; and <br />B. Acts to appropriate the necessary funds required to implement the <br />provisions of this MOU that require funding. <br />3.2 Notwithstanding the foregoing, in the event the City Council fails to take all <br />actions necessary to implement this MOU in a timely manner, the parties <br />understand that they may mutually agree to implement appropriate <br />provisions of this MOU that do not require specific approval by the City <br />Council. <br />3.3 Implementation shall be effective as of the date the MOU is formally <br />approved by the City Council.
