1) STATEMENT OF QUALIFICATIONS <br />B. Agreement Statement <br />Desmond, Marcello & Amster concurs with the provisions in the sample agreement in <br />Attachment 2 of the Appendix of this RFP. <br />C. Understanding of Need <br />Budgetary Estimates <br />Budgetary estimates are used by public agencies in planning and preparing a project budget. <br />Upon request, DM &A can prepare budgetary estimates of goodwill loss based upon "drive by" <br />site inspections of the subject businesses, limited market research, and any publicly available <br />data. The estimates also take into consideration DM &A's experience in preparing goodwill loss <br />appraisals of comparable businesses, as well as knowledge of relevant statutes and case laws, <br />negotiated settlements, and jury awards in eminent domain proceedings. Results will be <br />presented in a brief letter. <br />The tasks necessary to complete budgetary estimates include coordination with the City and /or <br />the City's representatives to ascertain the location and number of businesses for which <br />estimates are needed. DM &A's appraisers will visit the business locations and do research via <br />public sources to gain any available understanding of the nature and scope of each business' <br />operations. Care is taken such that the confidentiality of DM &A's objective is strictly maintained <br />during this phase. Quality control is maintained via DM &A's review process as described below <br />We will then refer to various in -house documentation and the public sources to determine a <br />preliminary value for each business' goodwill. Further, we will utilize available information from <br />the City's representatives, and our experience, to estimate the potential impact of the proposed <br />project on each business' patronage and /or expense structure. Taking both "before" and "after" <br />factors into consideration, DM &A can provide estimates of potential goodwill loss to each <br />business. <br />Goodwill Lass Acquisition Appraisals <br />During the early stages of property acquisition, DM &A can provide preliminary estimates of <br />goodwill loss. Acquisition appraisals are based on data which may be provided by the business' <br />ownership at its discretion. Such information may include leases, background on the business <br />provided via owner /management interviews, historical and prospective financial data, and <br />information about proposed relocation sites. In addition, DM &A will perform basic transactional <br />research in light of our understanding of the business' operations and financial condition, <br />Consultant will also coordinate with real estate and fixtures and equipment appraisers to avoid <br />duplication of compensation. Further, DM &A's analyses will be guided by relevant statutory and <br />case law pertaining to compensation for loss of goodwill. <br />Our approach to the appraisal process is thorough, collaborative, and professional. Our <br />appraisers recognize the importance of a detailed approach to any assignment, and are <br />cognizant of our role as representing our clients. Our professionals have extensive experience <br />interviewing business owners, and make efforts to address their concerns and needs in these <br />meetings.
