Please read the endorsement and respective policy(les) carefully. Contractors POIllAtiOn Liability Coverage Form (Occurrence) SECTION I — Coverage: Contractor's Pollution Liability is deleted in its entirety and replaced with: SECTION I -COVERAGE Coverage: Contractor's Pollution Liability 1. Insuring Agreement a. We wiff pay those sums that the insured becornes legally obligated to pay as damages because of "bodily injury" or "property damage", provided: (1) The "bodily injury" or "property damage" Is caused by an "occurrence" that takes place in the "coverage territory" resulting in a "pollution incident" arising Out of "your work" performed, or "your product" delivered during the policy period; or out of the "products and completed operations hazard" of "your product" or "your work"; and (2) The "bodily injury" or "property damage" occurs during the policy period; and b. Progressive, indivisible "bodily injury" or "property damage" over a period of time caused by the same, continuous, repeated or related "pollution incident" shall be deemed to have Occurred only on the date of the first exposure to such "pollution incident". If the date of the first exposure is before the inception, date of the first Contractor's Pollution Liability policy issued to you by us or an affiliate, or cannot be determined, but the progressive, indivisible "bodily injury" or "property damage" continues in fact to exist during the policy period, it will be deemed to have occurred only on the inception date of the first Contractor 's Pollution Liability policy issued to you by us or an affiliate which is applicable to "your work" from which such "pollution incident" resulted. c. We will have the right and duty to defend the insured against any "suit' seeking those damages, However, we will have no duty to defend the insured against any "suit" seeking damages to which this insurance does not apply. We may, at our discretion, investigate arty "pollution incident" and settle any ..claim" or "suit' that may result. But: (1) The amount we will pay for damages is limited as described in SECTION III - LIMITS OF INSURANCE; and (2) Our right and duty to defend end when we have used up the applicable limit of insurance in the payrnent of judgments, settlements Or supplementary payments under this policy.
