person to influence, or attempt to influence an officer or employee of any agency, a Member of Congress,
<br />an officer or employee of Congress, or an employee of a Member of Congress in connection with any
<br />Federal action concerning the award or renewal of any Federal contract, grant, loan, or cooperative
<br />agreement.
<br />26. Agrees that, to the extent contractors or subcontractors are utilized, will use small, minority- owned,
<br />women - owned, or disadvantaged businesses, to the extent practicable.
<br />27. Will comply with Title 2 of the Code of Federal Regulations Part 225, Appendix A, paragraph (C)(3)(c),
<br />which provides that any cost allocable to a particular Federal award or cost objective under the principles
<br />provided for in this authority may not be charged to other Federal awards to overcome fund deficiencies.
<br />28. Will ensure that Federal funds do not replace (supplant) funds that have been budgeted for the same purpose
<br />through non- Federal sources. Subgrantees and subrecipients may be required to demonstrate and document
<br />that a reduction in non- Federal resources occurred for reasons other than the receipt or expected receipt of
<br />Federal funds.
<br />29. Will comply, if applicable, with the Lead -Based Paint Poisoning Prevention Act (42 U.S.C. § 4801 et seq.),
<br />which prohibits the use of lead based paint in construction or rehabilitation of structures.
<br />30. Will comply with all federal and state laws and regulations relating to civil rights protections and
<br />nondiscrimination. These include, but are not limited to:
<br />a. Title VI of the Civil Rights Act of 1964, Public Law 88 -352, (42 U.S.C. § 2000d et seq.), codified at
<br />6 CFR Part 21 and 44 CFR Part 7, which provides that no person in the United States will, on the
<br />grounds of race, color, or national origin, be excluded from participation in, be denied the benefits of,
<br />or be subjected to discrimination rmder any program or activity receiving Federal financial assistance.
<br />b. Title IX of the Education Amendments of 1972, as amended (20 U,S.C. § 1681 or seq.), which
<br />prohibits discrimination on the basis of gender in educational programs and activities. These
<br />regulations are codified at 6 CFR Part 17 and 44 CFR Part 19.
<br />c. The Americans with Disabilities Act, as amended, which prohibits recipients from discriminating on
<br />the basis of disability in the operation of public entities, public and private transportation systems,
<br />places of public accommodation, and certain testing entities (42 U.S.C. § 12101 et seq.),
<br />d. The Age Discrimination Act of 1975, as amended (42 U.S.C. §§ 6101 et seq.), which prohibits
<br />discrimination on the basis of age in any program or activity receiving federal financial assistance,
<br />c. The Drug Abuse Office and'freaYment Act of 1972 (P.L. 92 -255), as amended, relating to
<br />nondiscrimination on the basis of drug abuse.
<br />f The Comprehensive Alcohol Abuse and Alcoholism Prevention, Treatment and Rehabilitation Act of
<br />1970 (P.L. 91 -616), as amended, relating to nondiscrimination on the basis of alcohol abuse or
<br />alcoholism.
<br />g. Sections 5233 and. 527 of the Public Health Service Act of 1912 (42 U.S.C. § 290 dd -3 and 290 ee -3),
<br />as amended, relating to confidentiality of alcohol and drug abuse patient records.
<br />h. Title Vill of the Civil Rights Act of 1968 (42 U,S.C. § 3601 et seq., as implemented by 24 CFR Part
<br />100), as amended, relating to nondiscrimination in the sale, rental and financing of housing.
<br />i. Title 44 of the Code of Federal Regulations (CFR) Parts 7, 16, and 19 relating to nondiscrimination.
<br />.j. The requirements of any other nondiscrimination provisions in the specific statute(s) under which the
<br />application for Federal assistance is being made and any other applicable statutes,
<br />k. The requirements of Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794, as amended,
<br />which provides that no otherwise qualified individual with a disability in the United States will, solely
<br />by reason of the disability, be excluded from participation in, be denied the benefits of, or be
<br />subjected to discrimination under any program or activity receiving Federal financial assistance.
<br />These requirements pertain to the provision of benefits or services as well as to employment.
<br />I. Will, in the event that a Federal or State court or Federal or State administrative agency makes a
<br />finding of disnrittunation after a due process hearing on the grounds or race, color, religion, national
