CEQA FINDINGS OF FACT <br />WARNER AVENUE IMPROVEMENTS AND WIDENING <br />FROM MAIN STREET TO GRAND AVENUE <br />FINAL ENVIRONMENTAL IMPACT REPORT <br />STATE CLEARINGHOUSE NO. 2012101004 <br />Exhibit A <br />INTRODUCTION <br />The California Environmental Quality Act (CEQA) requires that a number of written findings be <br />made by the lead agency in connection with certification of an environmental impact report (EIR) <br />prior to approval of the project (Sections 15091 and 15093 of the CEQA Guidelines and Section <br />21081 of the Public Resources Code). This document provides the findings required by CEQA <br />and the specific reasons for considering the project acceptable even though the project has <br />significant impacts that are infeasible to mitigate. <br />The lead agency is responsible for the adequacy and objectivity of the EIR. The City of Santa <br />Ana, as lead agency, has subjected the Draft EIR and Final EIR to its own review and analysis. <br />The City of Santa Ana City Council certifies that the Draft EIR, Final EIR, and Findings of Fact <br />reflect the independent judgment of the City. <br />A. FINDINGS OF FACT <br />The City of Santa Ana, as lead agency, is required under CEQA to make written findings <br />concerning each alternative and each significant environmental impact identified in the Draft EIR <br />and Final EIR. CEQA Guidelines Section 15091 provides: <br />(a) No public agency shall approve or carry out a project for which an FIR <br />has been certified which identifies one or more significant environmental <br />effects of the project unless the public agency makes one or more written <br />findings for each of those significant effects, accompanied by a brief <br />explanation of the rationale for each finding. The possible findings are: <br />1. Changes or alterations have been required in, or incorporated into, <br />the project which avoid or substantially lessen the significant <br />environmental effect as identified in the Final EIR. <br />2. Such changes or alterations are within the responsibility and <br />jurisdiction of another public agency and not the agency making the <br />finding. Such changes have been adopted by such other agency or <br />can and should be adopted by such other agency. <br />3. Specific economic, legal, social, technological, or other <br />considerations, including provision of employment opportunities for <br />highly trained workers, make infeasible the mitigation measures or <br />project alternatives identified in the Final EIR. <br />CEQA Findings of Fact - 1 - <br />Warner Avenue Improvements & Widening from Main Street to Grand Avenue Aug 2015 <br />75B -13 <br />
