agreement with the City can pay new fees or remain the same, but if no <br />contract then new fees will apply. <br />Councilmember Benavides, asked about pipeline projects with pending <br />contracts. <br />Executive Director of Planning and Building Agency, Haghani, noted that <br />status of pending projects would be provided to the City Council for <br />consideration. <br />Councilmember Benavides, proposed friendly amendment to allow all <br />pending projects the option of current or proposed regulations. <br />Executive Director of Planning and Building Agency Haghani, summarized <br />proposed amendments include: 1. Change definition of moderate income <br />formula from 110% to 80% AMI; 2. Change in lieu fee to $15 per square <br />foot; 3. Developer should have opportunity to opine as to where in -lieu <br />fees should be spent; 4. Development projects in the pipeline be given <br />choice of existing formula for in -lieu fees or proposed rate of $15 per <br />square foot with the understanding that projects over 21 units must <br />produce the housing on -site. <br />Councilmember Benavides, clarified that developers would be given a <br />voice although City has final decision since they are public funds. <br />AMENDED MOTION: Place amended ordinance on first reading and <br />authorize publication of title. <br />ORDINANCE NO.
