INCIDENTAL MEDICAL MALPRACTICE <br />1. The following ieadded tothe definition of"oc- <br />currence" in the DEFINITIONS Section: <br />Unless you are in the business oroccupation <br />of providing professional health care services, <br />"ocourrence" also means an act or omission <br />committed in providing or failing to provide <br />"incidental medical services" to m person. <br />2. The following is added to the DEFINITIONS <br />Section: <br />"Incidental medical services" means: <br />a Modioo|, surgical, dental, |abunatop/, x-ray <br />or nursing service or treatment, advice or <br />inatruction, or the related furnishing of <br />food orbeverages; <br />b. The furnishing or dispensing of drugs or <br />medical, dente|, or surgical supplies or <br />c. First aid; or <br />3. The following is added to Paragraph .(1) of <br />SECTION U—WHO IS AN INSURED: <br />Unless you are in the business <br />of providing professional health care services, <br />Paragraphs (1)(a), (b), (c) and (d) above do <br />not apply to any "bodily injury" arising out of <br />any providing or failing to provide "incidental <br />medical services" by any of your "employees", <br />other than an employed doctor. Any such <br />'.employees" providing or failing to provide <br />"incidental medical services" during their work <br />hours for you will be deemed to be acting <br />within the scope of their employment by you <br />or performing duties related to the conduct of <br />your business. <br />4. The following exclusion is added to Para- <br />graph 2'. Exclusions, of SECTION | — COV- <br />ERAGES—COVER#GE A BODILY INJURY <br />AND PROPERTY DAMAGE LIABILITY: <br />Sale OfPharmaceuticals <br />"Bodily damage" arising <br />out of the willful violation of a penal statute or <br />ordinance relating to the sale of pharmaceuti- <br />cals committed by, or with the knowledge or <br />consent of, the insured. <br />6.
