General Information Notice <br />Non -Residential Occupant to Be Displaced <br />June 26, 2013 <br /><<Name>> <br /><<Business Name>> <br /><<Address>> N. Santiago Street <br />Santa Ana, CA 92701 <br />Dear <<Name>>: <br />The Depot at Santiago, LP (called here the "Developer's is interested in acquiring the property <br />you currently occupy at <<Address>> N. Santiago Street, Santa Ana, CA for their proposed <br />housing project, the Depot at Santiago Project (called here the "Project"). This notice is to inform <br />you of your rights under Federal law. If the Developer acquires the property, and you are displaced <br />for the Project, you will be eligible for relocation assistance under the Uniform Relocation Assistance <br />and Real Property Acquisition Policies Act of 1970 (URA), as amended and HUD Handbook 1378. <br />However, you do not have to move now. <br />This is not a notice to vacate the premises or a notice of relocation eligibility. <br />If the property is acquired, relocation activities would not start <br />from 1 to 1'/2 years from today. <br />The Developer has retained the professional firm of Overland, Pacific & Cutler, Inc. (OPC) to <br />represent the Developer and assist in the relocation process. <br />In order to assess and better plan for the relocation needs of possible displaced non-residential <br />occupants in the Project, the Developer is preparing a Relocation Plan. In order to prepare this <br />relocation plan, OPC staff will need to meet with you at your place of business to assess your <br />relocation needs. OPC will be in the area of your business beginning the week of June 24th and will <br />be trying to contact you then. If you want to make an appointment that is convenient for you, <br />please call the relocation agent identified below. <br />Laura Kane <br />1-800/901-5263 <br />If you rent or lease your unit, you should continue to pay your monthly rent to your landlord because <br />failure to pay rent and meet your obligations as a tenant may be cause for eviction and loss of <br />relocation assistance. You are urged not to move or sign any agreement to purchase or lease a unit <br />before receiving formal notice of eligibility for relocation assistance. If you move or are evicted <br />before receiving such notice, you will not be eligible to receive relocation assistance. <br />Please contact us before you make any moving plans. If the Developer acquires the property and <br />you are eligible for relocation assistance, you will be given advisory services, including referrals to <br />replacement sites, and at least 90 days advance written notice of the date you will be required to <br />move. You would also receive either a payment for actual moving and reestablishment expenses, or, <br />a fixed payment in lieu of a payment for actual moving and reestablishment expenses. <br />Pursuant to the Public Law 105-117, in order to be eligible to receive non-residential relocation <br />benefits in federally -funded projects, in the case of an unincorporated business, each owner must be <br />55A-34 <br />
