6. Resolution of Future Dispute <br />During the term of this Agreement, each party agrees <br />to act in good faith to amicably and expeditiously resolve any <br />dispute with the other party, or the members of the city council <br />of the other party, or any officers of the other party, or a re- <br />development agency of the other party or the members or officers <br />thereof, involving the approval of any contract, permit, license <br />or entitlement of use for any development project or development <br />plan or regulation located within the territorial jurisdiction <br />of such other party. <br />As used herein, "development project" includes any <br />activity which would require the issuance of a building permit <br />under the building code of the party having jurisdiction over <br />the activity. <br />As used herein, "development plan or regulation" in- <br />cludes a general or specific plan or element thereof, a re- <br />development plan, a zoning ordinance or regulation, or any <br />amendment thereto. <br />7. Term <br />This Agreement shall become effective as of the date <br />hereof and shall continue in full force and effect until <br />January 1, 2010, unless sooner terminated as hereinafter provided. <br />However, this Agreement shall, if necessary, continue beyond <br />January 1, 2010 to the extent necessary to implement the <br />Settlement Agreement. <br />-12- <br />
