13.10 Credit for Unused Sick Leave. All employees covered by this MOU can have unused <br />accumulated sick leave at the time of retirement converted to additional service credit, <br />pursuant to regulations prescribed by PERS. The City must report only those hours of <br />unused sick leave that were accrued by the employee during the normal course of <br />employment. This section applies to members whose effective date of retirement is <br />within four (4) months of separation from employment. <br />ARTICLE XIV <br />14.0 RELEASE TIME FOR ASSOCIATION REPRESENTATIVE <br />During the term of this MOU, the City agrees to grant full -time release from duty for one (1) <br />Association representative for the conduct of Association affairs subject to the following: <br />14.1 The Association shall reimburse the City for one hundred percent (100 %) of salary <br />(including any salary additives, such as career incentive pay) and benefit costs. Such <br />reimbursement may be from the bank established pursuant to Section 8.15 of Article VIII <br />of this MOU. The parties agree as follows: <br />A. The POA President will be compensated at a rate consistent with his or her <br />departmental rank including all assignment pay, pay additives, and premimns in <br />place at the time he or she assumes the position of POA President. <br />B. The value of the President's pay will include base salary, pension, premiums, and <br />medical only. <br />C. The value of the Floating Holiday donations will include base salary, pension, <br />premiums, and Medicare. <br />D. The City shall pay the POA President a "Confidential Premium" in lieu of 20 <br />hours per pay period at time and one -half. This premium is contained in the <br />California Public Employees' Retirement Law (PERL) and is described as <br />"compensation to rank and file employees who are routinely and consistently <br />assigned to sensitive positions requiring trust and discretion." The parties agree <br />that the value of this premium shall be equivalent to 28 hours of pay at straight <br />time per pay period. The rate paid shall be tied to the incumbent's rank. The <br />POA agrees that the acceptance of said compensation as described in section E as <br />"PERSable" is subject to PERS approval and if it is determined that said <br />compensation is not "PERSable" the City is not obligated to provide additional <br />benefits. <br />E. The Police Chief shall allow on -duty time, (up to three days) for five board <br />members, once per year, to attend the Peace Officers' Memorial.
