ARTICLE XXIII <br />23.0 MISCELLANEOUS PROVISIONS <br />23.1 Reopener. The Association and City mutually agree to re -open the MOU to meet and <br />confer on the subjects of: <br />A. The use of body cameras; and <br />B. Implementation of the Lexipol Policy Manual. <br />23.2 Uniform Allowance. With respect to Safety and Miscellaneous employees who do not <br />qualify as "New Members" under the California Public Employees' Pension Reform Act <br />(PEPRA), the City shall report to Ca1PERS the monetary value of uniforms and uniform <br />maintenance for those employees required to wear uniforms. The monetary value by <br />classification is listed in Exhibit C, entitled "Uniform Allowance by Classification." The <br />value of the Uniform Allowance shall be determined by the City and will be reported to <br />the California Public Employees' Retirement System (CalPERS) for retirement purposes <br />only. <br />Under CCR 571(a), Uniform allowance is defined as "Compensation paid or the <br />monetary value for the purchase, rental and/or maintenance of required clothing, <br />including clothing made from specially designed protective fabrics, which is a ready <br />substitute for personal attire the employee would otherwise have to acquire and maintain. <br />This excludes items that are solely for personal health and safety such as protective vests, <br />pistols, bullets and safety shoes. <br />ARTICLE XXIV <br />24.0 SOLE AND ENTIRE AGREEMENT <br />23.1 It is the intent of the parties hereto that the provisions of this MOU shall supersede all <br />prior agreements and memoranda of agreement, or memoranda of understanding, or <br />contrary salary and /or personnel rules and regulations or administrative codes, provisions <br />of the City, oral and written, expressed or implied, between the parties, and shall govern <br />the entire relationship and shall be the sole source of any and all rights which may be <br />asserted hereunder. This MOU is not intended to conflict with federal or state law or the <br />City Charter. <br />23.2 The City will continue to administer its employee relations and its personnel policies and <br />procedures in accordance with duly- adopted ordinances and resolutions, and the affected <br />employees will continue to be governed thereby during the term of this MOU. <br />mil <br />
