Adopt an ordinance approving the Development Agreement No, 2015 -03 as amended, <br />6. Adopt a resolution approving Vesting Tentative Tract Map No. 2015 -03 as conditioned, <br />6. Adopt a resolution finding the project to be consistent with the purposes of the State <br />Aeronautics Act. <br />i. Option to consider modifying proposed Development Agreement to direct the in -lieu housing <br />fees as recommended by the Planning Commission. <br />PLANNING COMMISSION ACTION <br />At its regular meeting on October 12, 2015 by a vote of 5 :0 (Nalle & Verino absent), the Planning <br />Commission recommended that the City Council approve The Heritage project, a mixed -use <br />development on an existing industrial site at 2001 East Dyer Road located in the Light Industrial <br />(M -1) zoning district. The Planning Commission added a recommendation to direct the in -lieu <br />housing fees to a project proposed by AMCAL on East First Street as permitted by Section 41T <br />1004(c)(3) of the recently amended Housing Opportunity Ordinance. This recommendation was <br />not included In the Development Agreement currently before the City Council, Should the City <br />Council decide to approve this recommendation, Council may direct staff to modify the proposed <br />75A -1 <br />
