ARTICLE 5 <br />MISCELLANEOUS <br />I. Term of the Inclusionary Housing Covenants Declaration <br />This Inclusionary Housing Covenants Declaration shall become effective <br />upon its execution and delivery. <br />2. This Inclusionary Housing Covenants Declaration shall terminate as to the <br />Inclusionary Unit at the earliest of: <br />a. as provided under the terms and conditions of any subordination <br />agreement between a Senior Lender and the City; or <br />b. upon the close of escrow for an Extraordinary Sale; or <br />C. at the end of the Affordability Period. <br />3. Upon termination of the Affordability Period, on request of the then record <br />Owner of the Property, the City shall execute, acknowledge and record a <br />termination of the Inclusionary Housing Covenants Declaration and the <br />City Deed of Trust. To the extent permitted by law, any unfulfilled <br />obligations of any Owner shall survive the termination of the Inclusionary <br />Housing Covenants Declaration, but it shall no longer affect title to the <br />Property. <br />II. Maintenance and Use <br />1. The Owner shall maintain the interior and exclusive use areas of the <br />Inclusionary Unit in a clean, well maintained condition consistent with the <br />neighborhood, as set forth in the Project CC &Rs. <br />2. The Inclusionary Unit shall be used and occupied by the Owner solely for <br />residential purposes, and in addition to the residential purpose may also <br />be used for any accessory uses that comply with the provisions of the <br />Santa Ana Municipal Code, as it may be amended from time to time. <br />3. No Owner shall grant use of, rent or lease all or any part of the <br />Inclusionary Unit, but shall occupy the Inclusionary Unit as its Primary <br />Residence. <br />Inclusionary Housing Covenants Declaration Page 27 <br />City of Santa Ana January 2015 <br />
