story 56,000 square foot office building and a 108 space surface <br />parking lot. The exterior of the office building would be renovated <br />to be consistent with the proposed architectural design of the new <br />mixed -use buildings. The existing office portion of the structure <br />provides 36,000 square feet of employee generating space and <br />20,000 square feet of data center use that contains only computer <br />equipment. <br />(c) The residential units would range in size from 512 square foot <br />studios to 1,290 square foot one - bedroom and two - bedroom units. <br />Three parking structures would also be developed, one structure for <br />each mixed -use building. The proposed project includes both <br />public and private (for residents) open space and recreational <br />facilities on the project site. A 1.26 acre public central park, <br />including various amenities, would be developed and would <br />connect to open space areas along the northern and eastern <br />boundaries. In addition, approximately 327,302 square feet of <br />private open space, as well as private recreation amenities would <br />be provided for residents. <br />1.3 Code Authorization. City is authorized pursuant to Government Code <br />Sections 65864 through 65869.5 to enter into Development Agreements <br />with persons having legal or equitable interests in real property for the <br />purpose of establishing development certainty for both the City and Owner <br />in the development process. City enters into this Development Agreement <br />pursuant to the provisions of the Government Code and applicable City <br />policies. The Parties acknowledge: <br />(a) This Development Agreement is intended to assure adequate <br />public facilities at the time of development. <br />(b) This Development Agreement is intended to assure development in <br />accordance with City's General Plan, and any applicable Specific <br />Plans. <br />(c) This Development Agreement will permit achievement of goals and <br />objectives as reflected in the City's General Plan, and any and all <br />applicable Specific Plans. <br />(d) Owner is required by existing City regulations to provide mitigation <br />for certain identified impacts and pay certain regulatory fees as <br />conditions of approvals through the regulatory process. <br />(e) This Development Agreement will allow City to realize extraordinary <br />and significant public infrastructure facilities and other supplemental <br />benefits in addition to those available through the existing <br />regulatory process. <br />
