LS 1.25.16 <br />RESOLUTION NO. 2016 -012 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA ADOPTING FINDINGS AND A STATEMENT OF <br />OVERRIDING CONSIDERATIONS PURSUANT TO THE <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT; <br />CERTIFYING FINAL ENVIRONMENTAL IMPACT REPORT <br />NO. 2015 -01; ADOPTING THE MITIGATION MONITORING <br />PROGRAM; APPROVING GENERAL PLAN AMENDMENT <br />NO. 2015 -03; AND, APPROVING VESTING TENTATIVE <br />TRACT MAP NO. 2015 -03 AS CONDITIONED FOR THE <br />PROPERTY LOCATED AT 2001 EAST DYER ROAD <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. Applicant is requesting the certification of Environmental Impact Report <br />(EIR) No. 2015 -01, the approval of General Plan Amendment No. 2015 -03 <br />to amend the General Plan to change the land use designation from <br />Industrial (IND) to District Center (DC), and the approval of Vesting Tentative <br />Tract Map No. 2015 -03 to allow construction of The Heritage mixed -use <br />development project that would include 1,221 apartment homes, 12,675 <br />square feet of retail commercial space, and 5,415 square feet of restaurant <br />space on an 18.84 acre parcel of land at 2001 East Dyer Road. <br />B. On October 12, 2015, the Planning Commission held a duly noticed public <br />hearing and voted to recommend that the City Council: (1) adopt a <br />resolution certifying Final Environmental Impact Report No. 2015 -01 and <br />approving the Mitigation Monitoring Program, Findings of Fact and <br />Statement of Overriding Considerations; (2) adopt a resolution approving <br />General Plan Amendment No. 2015 -03; and, (3) adopt a resolution <br />approving Vesting Tentative Tract Map No. 2015 -03 as conditioned, for the <br />proposed project. <br />C. On February 2, 2016, the City Council of the City of Santa Ana held a duly <br />noticed public hearing to consider all testimony, written and oral, related to <br />Final Environmental Impact Report No. 2015 -01, General Plan <br />Amendment No. 2015 -03, and Vesting Tentative Tract Map No. 2015 -03, at <br />which time all persons wishing to testify were heard, the project was fully <br />considered, and all other legal prerequisites to the adoption of this <br />Resolution occurred. <br />Resolution No. 2016 -012 <br />Page 1 of 10 <br />
